It is not a professional forensic service, not a certified data recovery lab, and not a guarantee that any file, folder, photo, video, document, partition, disk, device, or storage media can be recovered. Recovery is not guaranteed. All use is at the user's own risk. RBJRJ Photo Rescue scans storage media for recoverable photo, video, document, and file data, but recovery success depends on many factors outside RBJRJ Photo Rescue's control, including: - Whether deleted data has been overwritten - SSD TRIM behavior - File fragmentation - File-system damage - Physical drive failure - Bad sectors - Malware or encryption damage - Prior repair attempts - User actions before, during, or after scanning - Operating system permissions and disk access restrictions - Third-party software, drivers, antivirus tools, and storage hardware behavior Important safety rules: 1. Stop using the source drive immediately. 2. Do not install this software on the drive you want to recover from. 3. Do not save recovered files to the source drive. 4. Create a disk image first when a drive is unstable. 5. Use a professional recovery lab for clicking, overheating, disappearing, or physically damaged drives. No warranty: To the maximum extent permitted by applicable law, RBJRJ Photo Rescue is provided "as is," "with all faults," and "as available," without any express, implied, statutory, or other warranty of any kind. This includes, without limitation, warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, error-free operation, compatibility, accuracy, recovery success, or data integrity. User responsibility: The user is solely responsible for choosing the source drive, output folder, scan options, recovered files, repair actions, and any continued use of the source device. The user is solely responsible for backing up important data, preserving original storage media, and deciding whether to use a professional recovery lab. The user is solely responsible for using RBJRJ Photo Rescue only on storage media and files that the user owns or is legally authorized to access. The software may not be used for fraud, unauthorized access, privacy violations, evidence destruction, illegal copying, infringement, harassment, extortion, or any unlawful purpose. No reliance: No statement, preview, scan result, marketing text, website text, support message, screenshot, or trial result is a promise, guarantee, professional opinion, forensic opinion, or warranty that any data will be recovered, repaired, usable, complete, or safe to rely on. Limitation of liability: To the maximum extent permitted by applicable law, RBJRJ Photo Rescue and its affiliates, licensors, distributors, and suppliers are not liable for any direct, indirect, incidental, special, consequential, exemplary, punitive, or similar damages arising from or related to use of the software, inability to use the software, scan results, failed recovery, incomplete recovery, corrupted files, overwritten data, lost data, lost profits, lost revenue, business interruption, loss of goodwill, hardware damage, device failure, third-party claims, or the cost of substitute services, even if advised of the possibility of such damages. To the maximum extent permitted by applicable law, RBJRJ Photo Rescue has no liability. If, despite this exclusion, liability is found by a court or cannot legally be excluded, the maximum total liability is limited to the amount actually paid by the user for the software license during the twelve months before the claim, or USD $10.00, whichever is less, where permitted by law. Indemnification: To the maximum extent permitted by applicable law, the user agrees to defend, indemnify, and hold harmless RBJRJ Photo Rescue and its affiliates, licensors, distributors, and suppliers from and against any claims, losses, liabilities, damages, costs, and expenses, including reasonable attorney fees, arising from or related to the user's use or misuse of the software, violation of law, violation of third-party rights, recovery or handling of third-party data, selected source or output location, or continued use of damaged storage media. Claims: To the maximum extent permitted by applicable law, any claim related to the software, license, website, purchase, support, activation, scan, repair, or recovery must be brought only on an individual basis and not as a class, collective, consolidated, representative, private attorney general, or similar action. Any claim must be brought within one year after the event giving rise to the claim, unless a longer period is required by applicable law. Refund policy: RBJRJ Photo Rescue provides a trial/free scan so customers can check whether recoverable files are found before purchasing. Refund requests must be submitted within 30 days of purchase. Refunds may be approved if the software has a confirmed technical issue that prevents activation or normal use and support cannot provide a working solution. Refunds are generally not available after a license key has been issued and activated, after files have been successfully recovered or exported, for buyer's remorse, for choosing the wrong product, for unsupported devices or file types, for damaged or overwritten data, or for recovery results affected by drive condition, formatting, prior use, encryption, TRIM/SSD behavior, bad sectors, or hardware failure. If a refund is approved, the license may be deactivated and the customer must uninstall the software and stop using the license. Acceptance: By installing, activating, opening, scanning with, repairing with, recovering with, or otherwise using this software, the user acknowledges and accepts this disclaimer and assumes all risk connected with use of the software and the storage media involved. Some jurisdictions do not allow certain warranty exclusions or liability limitations, so some parts of this disclaimer may not apply in full.
