RBJRJ Photo Rescue Legal Terms and Recovery Disclaimer Copyright (c) 2026 RBJRJ Photo Rescue. All rights reserved. Read these terms carefully before installing or using RBJRJ Photo Rescue. By clicking "I accept the agreement," installing, activating, opening, scanning with, repairing with, recovering with, or otherwise using this software, you agree to the End User License Agreement and Recovery Disclaimer included with this software. 1. License This software is licensed, not sold. Each license is limited, non-exclusive, non-transferable, and bound to the activated computer unless your purchase terms say otherwise. You may not share, sell, resell, rent, lease, publish, distribute, or otherwise make the software or license key available to another person without written permission from RBJRJ Photo Rescue. 2. Prohibited Use You may not reverse engineer, decompile, disassemble, modify, translate, adapt, create derivative works from, bypass trial limits, bypass activation, patch, crack, tamper with, emulate, spoof, disable, or interfere with any licensing, security, copy protection, activation, or anti-abuse mechanism in the software. You may not use the software, documentation, interface, recovered output, screenshots, binaries, package files, installer, license format, or activation workflow to build, train, clone, copy, benchmark for cloning, or assist in creating a competing or substantially similar product, except where applicable law expressly prohibits this restriction. You may use the software only on storage media and files that you own or are legally authorized to access. You may not use it for fraud, unauthorized access, privacy violations, evidence destruction, illegal copying, infringement, harassment, extortion, or any unlawful purpose. 3. Recovery Disclaimer Data recovery is not guaranteed. Results depend on drive condition, overwritten data, file fragmentation, SSD TRIM, file-system damage, malware damage, hardware failure, bad sectors, user actions, operating system restrictions, third-party software, and other factors outside RBJRJ Photo Rescue's control. Recovered files may be incomplete, corrupted, duplicated, renamed, unusable, or unrecoverable. Always recover files to a different drive. Saving recovered files to the source drive can permanently overwrite deleted data. If a drive clicks, disconnects, becomes very slow, overheats, or is not reliably detected, stop using it and consult a professional recovery lab. 4. User Responsibility You are solely responsible for choosing the source drive, output folder, scan options, recovered files, repair actions, and any continued use of the source device. You are solely responsible for backing up important data, preserving original storage media, and deciding whether to use a professional recovery lab. No statement, preview, scan result, marketing text, website text, support message, screenshot, or trial result is a promise, guarantee, professional opinion, forensic opinion, or warranty that any data will be recovered, repaired, usable, complete, or safe to rely on. 5. No Warranty To the maximum extent permitted by applicable law, RBJRJ Photo Rescue is provided "as is," "with all faults," and "as available," without any express, implied, statutory, or other warranty of any kind, including warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, error-free operation, compatibility, accuracy, recovery success, or data integrity. 6. Limitation of Liability To the maximum extent permitted by applicable law, RBJRJ Photo Rescue and its affiliates, licensors, distributors, and suppliers are not liable for any direct, indirect, incidental, special, consequential, exemplary, punitive, or similar damages arising from or related to use of the software, inability to use the software, scan results, failed recovery, incomplete recovery, corrupted files, overwritten data, lost data, lost profits, lost revenue, business interruption, loss of goodwill, hardware damage, device failure, third-party claims, or the cost of substitute services, even if advised of the possibility of such damages. To the maximum extent permitted by applicable law, RBJRJ Photo Rescue has no liability. If, despite this exclusion, liability is found by a court or cannot legally be excluded, the maximum total liability is limited to the amount actually paid by you for the software license during the twelve months before the claim, or USD $10.00, whichever is less, where permitted by law. 7. Indemnification To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless RBJRJ Photo Rescue and its affiliates, licensors, distributors, and suppliers from and against any claims, losses, liabilities, damages, costs, and expenses, including reasonable attorney fees, arising from or related to your use or misuse of the software, your violation of law, your violation of third-party rights, your recovery or handling of third-party data, your selected source or output location, or your continued use of damaged storage media. 8. Refund Policy RBJRJ Photo Rescue provides a trial/free scan so customers can check whether recoverable files are found before purchasing. Refund requests must be submitted within 30 days of purchase. Refunds may be approved if the software has a confirmed technical issue that prevents activation or normal use and support cannot provide a working solution. Refunds are generally not available after a license key has been issued and activated, after files have been successfully recovered or exported, for buyer's remorse, for choosing the wrong product, for unsupported devices or file types, for damaged or overwritten data, or for recovery results affected by drive condition, formatting, prior use, encryption, TRIM/SSD behavior, bad sectors, or hardware failure. If a refund is approved, the license may be deactivated and you must uninstall the software and stop using the license. 9. Claims To the maximum extent permitted by applicable law, any claim related to the software, license, website, purchase, support, activation, scan, repair, or recovery must be brought only on an individual basis and not as a class, collective, consolidated, representative, private attorney general, or similar action. Any claim must be brought within one year after the event giving rise to the claim, unless a longer period is required by applicable law. Some jurisdictions do not allow certain warranty exclusions, liability limitations, claim limitations, or indemnity provisions, so some parts of these terms may not apply in full. In those jurisdictions, these terms apply to the maximum extent permitted by law. The full End User License Agreement and Recovery Disclaimer are installed with the software and are incorporated into these installation terms.
